Scenario 1: Consideration and Capacity

Lucinda is on her way home to Grand Rapids, Michigan, from boarding school in Lansing Michigan to celebrate her 17th birthday with family. Lucinda’s car has a flat tire in an ice storm and skids into a ditch. Lucinda is able to walk to the nearest house where an elderly couple offers her food and shelter until her car can be fixed. Two days later, the snowplows cleared the road, the car is pulled out of ditch, the tire is repaired, and Lucinda is on her way home. Lucinda’s mother, Louise, is so appreciative of the couple’s care for her daughter that she sends them an email promising to pay $500 to help cover the expenses. Living on a fixed income, the elderly couple accepts the offer by return email. Lucinda and her mother get into an argument and Louise refuses to pay couple.

Scenario 2: Types of Contracts

Dr. Brown was an adjunct instructor North State University (NSU) in Michigan. Each semester, near the beginning of each term, the parties executed a written contract that always included the following provision: “The parties acknowledge that this agreement may be cancelled by NSU or the instructor at any time before the first class session.” In the spring semester of Brown’s sixth year, he filed a complaint with NSU claiming that one of his students, Sylvia Davis, had engaged in inappropriate and disruptive classroom conduct. Brown gave her an “incomplete” grade and asked NSU to require her to apologize as a condition of receiving a final grade. NSU claimed, and Brown denied, that he was told to assign Davis a grade if he wanted to teach in the fall. Toward the end of the semester, Brown was told which classes he would teach in the fall, but the parties did not sign a written contract. The Wednesday before classes began, NSU terminated him. Brown filed a suit against NSU and others, alleging breach of contract.

Walker Honda, an automobile dealership that sold new cars, leased several properties from Commercial One, a leasing company. Walker sued Commercial One to recover the insurance proceeds. Then days before the trial started, Commercial One served Walker a document titled “Offer to Compromise Before Trial,” which was a settlement offer of $120,000. Walker agreed to the amount of the settlement but made it contingent on the execution of a new lease. The next day, Commercial One notified Walker that they were revoking the settlement offer. Walker thereafter tried to accept the original settlement offer.

What is open for discussion is whether or not Huawei should have been banned from attending the show considering the active lawsuit against the company? What is the role/responsibility of other countries when it comes to dealing with Huawei? The role/responsibility that other countries have when it comes to dealing with Huawei is challenging to define because every nation has its own political, economic, and social agenda. Some more developed countries are more likely to be apprehensive in engaging with companies that have a history of theft, violations, and lawsuits. Other lesser-developed countries might view a partnership with Huawei as an excellent opportunity to advance and connect their national economies with technological advancements that they may not have the infrastructure to implement themselves. The United Kingdom has come under criticism by other Western powers for their downplaying of the threat posed by Huawei as the U.K. seeks to leverage its 5G technology there. As a safeguard measure, the Chinese firm is banned from supplying kits to “sensitive parts” of the network, known as the core and are excluded from areas near military bases and nuclear sites. Some have raised concerns that the Chinese will utilize the non-service areas to triangulate possible nuclear locations. For better or worse, progress towards implementing a Huawei 5G network in the U.K. has stalled with the COVID-19 epidemic. Recently, Huawei has been accused of utilizing the pandemic state of the world in trying to use the crisis for its own ends, and the Chinese state ends as the company used the coronavirus pandemic as a bargaining tool in its battle to remain a part of the U.K.’s 5G network system. Does this mean that the United States is wrong for suing Huawei? No, the United States is not wrong for desiring to protect the intellectual property of North American businesses and, by extension, the national security of the United States. It is my opinion that our country is correct in protecting the political and economic landscapes that other nations seek to take advantage of. There should be measures in place to protect companies like Huawei from taking advantage of our technological networks and economic markets. International trade laws need to reflect the reality that some countries use trade agreements for coercive means such as espionage and market manipulation. The one drawback that I have against this perspective stems from the labeling of a business as a criminal enterprise. I argue when is it appropriate for a country to wage war against a private company? Is this the beginning of other lawsuits against businesses that could be labeled something other than a business? It is tough to tell; I suspect that this is just the beginning of many more to come. Let me know what you think! With the economic power of China behind Huawei, Huawei is able to make decisions that most private countries wouldn’t be able to afford. Some of these decisions are extremely low prices, which attract consumers, and the ability to rapidly expand and incur losses that companies without a state backing can’t afford. Much like a conglomerate, Huawei is able to incur extreme financial loss and costs by supplementing these losses with gains/profits from other government-backed companies or subsidiaries. While Huawei strives to be as profitable as it can be, if there is a more pressing goal in mind, such as rapid global expansion, Huawei is able to incur these temporary losses in order to fulfill their immediate goal. Because of Huawei’s unique characteristic of being state-backed, they are able to engage in extreme price wars with domestic competitors. Although companies such as Verizon, TMobile, and Nvidia are very big companies, they are not state-backed. Therefore, while they can afford to lower their prices a tad, they cannot win a price war against Huawei. The lowered prices will however drive some consumers to purchase Huawei’s services and goods, regardless of the image or portrayal of the company itself. This is extremely concerning if you consider that Huawei may be stealing intellectual property from its competitors, so they would be able to release a similar service or model that a domestic company innovates, for far cheaper. Social The stealing of intellectual property as well as the idea that someone is able to extract data about you without your knowledge is a frightening one. Most people reject such acts, which is why IP protection laws are so sought after and accepted. The typical consumer probably does not place much weight on IP theft when it comes to choosing which service or product to buy. For the majority, price will heavily outweigh the allegation of IP theft to create the product or service in question. However, with the possibility of being spied on without one’s knowledge, then the situation shifts. People are extremely wary when it comes to information about themselves, and rightfully so. Therefore, the biggest social impact should come from the spying allegations, rather than IP theft, though IP theft can be just as damaging, if not more in the long run. Political As talked about previously, Huawei is like an extension of the Chinese government. The US is wary that introducing Huawei into the US will open the US up to the possibility of spying. Every move that the US does against Huawei, such as their RICO charge, will have to be extremely scrutinized and have extensive planning done before the move is made, as there will be a counter-charge from the Chinese government. We’ve seen this when the US placed a trade ban on Huawei. The Chinese government in turn placed additional tariffs and trade bans on the US as a counterattack, which escalated the trade war further. Therefore, the US must hesitate when it comes to actions or sanctions placed on Huawei as it can, and most likely will, impact other aspects of their relationship on the global stage. Future Implications There are two roads that I can foresee if the status quo remains the same. The first possibility would be that the United States allows Huawei to continue its operations and hopes that as China continues to strengthen itself on the world stage, they begin to concede more as an established superpower and take steps to reduce suspicions of IP theft
